Terms of Use

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Human Tales Technology Private Limited (“Company,” “THINGS,” “we,” “us,” or “our”), governing your access to and use of the THINGS App, including all features, AI agents, and services made available through it (collectively, the “Platform”).

By downloading, installing, accessing, or using the THINGS App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years of age to use THINGS. By using the Platform, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement. THINGS is intended for individual, personal, non-commercial use by users located in India.

2. Nature of the Platform

THINGS is an AI-native fashion discovery and inspiration platform. THINGS is not a marketplace and does not sell, manufacture, warehouse, or ship products. All products displayed on the Platform are sourced from and fulfilled by independent third-party brands and retailers (“Third-Party Sellers”). THINGS is not a party to any transaction between you and a Third-Party Seller. Any purchase you make is governed by the terms, conditions, and policies of the respective Third-Party Seller.

3. AI Agents and Automated Feed Generation

3.1 How AI Works on THINGS

THINGS uses artificial intelligence agents, including Ego (our conversational AI stylist), to search, retrieve, and curate products on your behalf. When you use the Platform, our AI systems analyse your stated preferences, profile data, activity history, and other contextual signals to generate a personalised discovery feed and provide styling recommendations. This process is automated.

3.2 AI Disclaimer — Limitations and Accuracy

THINGS’s AI systems, including Ego, are built on large language models and machine learning technologies. AI is an emerging technology. It is not perfect. Ego’s recommendations, opinions, styling advice, and generated content are produced by automated systems and may not always be accurate, complete, appropriate, or suitable for your specific needs.

By using the Platform, you acknowledge and agree that:

  • AI-generated content, including product recommendations, editorial copy, and styling advice, may occasionally be inaccurate, irrelevant, or unexpected.
  • THINGS does not guarantee the accuracy, appropriateness, or fitness for purpose of any AI-generated content.
  • In rare instances, AI systems may generate content that is unintended, imperfect, or potentially offensive. While we work continuously to improve our systems and implement safeguards, no AI system is infallible at this stage of the technology’s development.
  • The Company shall not be liable for any harm, loss, or damage arising from reliance on AI-generated content or from unintended outputs generated by the AI system. You use AI-generated content at your own discretion.

We are committed to improving the quality and safety of our AI systems over time. If you encounter content that you believe is inappropriate or harmful, please report it immediately to contact@thesnug.app.

4. ME — Virtual Try-On: Personal Use and Prohibited Conduct

4.1 Personal Use Only

ME, THINGS’s AI-powered virtual try-on feature, is provided exclusively for your personal, private use to assist you in making informed fashion purchase decisions. You may use ME only with your own photo, for your own use, on your own device.

4.2 Prohibited Use of ME

The following uses of ME are strictly prohibited and constitute a serious violation of these Terms:

  • Using ME with photographs of any person other than yourself without their explicit written consent
  • Using ME to generate, manipulate, or create images for the purpose of harassing, humiliating, defaming, or causing distress to any individual
  • Sharing, publishing, or distributing ME-generated images of any person without their explicit consent
  • Using ME-generated images in any manner that constitutes cyberbullying, online harassment, non-consensual intimate imagery, or any form of abuse
  • Using ME for any commercial purpose or in any manner inconsistent with personal use

4.3 Consequences of Misuse

Any violation of Section 4.2 will result in:

  • Immediate and permanent account suspension without notice or refund
  • Reporting of the conduct to relevant law enforcement authorities where required by law or where the Company determines it is appropriate
  • Full legal cooperation with any investigation by law enforcement, courts, or regulatory authorities arising from the misuse of ME

THINGS takes the safety and dignity of individuals seriously. We will not hesitate to cooperate with legal proceedings where ME has been used to harm others.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access to your account at contact@thesnug.app. THINGS shall not be liable for any loss arising from unauthorised use of your account.

6. User Conduct

By using the Platform, you agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law
  • Attempt to reverse engineer, decompile, or extract source code from the Platform or its AI systems
  • Scrape, crawl, or systematically extract data from the Platform
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Upload or transmit any content that is defamatory, obscene, hateful, or otherwise objectionable
  • Interfere with or disrupt the integrity or performance of the Platform
  • Attempt to circumvent any security or access control mechanism of the Platform

7. Intellectual Property

7.1 THINGS Content

All content on the Platform — including the THINGS brand, Ego, the feed architecture, editorial copy, AI systems, and all associated technology — is the exclusive property of Human Tales Technology Private Limited or its licensors. Nothing in these Terms grants you any rights in THINGS’s intellectual property.

7.2 Third-Party Product Content

Product images, descriptions, and brand assets displayed on the Platform belong to their respective Third-Party Sellers. THINGS displays this content for discovery and inspiration purposes. We follow DMCA and applicable Indian copyright law with respect to third-party intellectual property.

7.3 DMCA Takedown Policy

If you believe that content on the Platform infringes your intellectual property rights, please submit a written takedown request to contact@thesnug.app with the following:

  1. Identification of the copyrighted work claimed to be infringed
  2. Identification of the infringing content (with URL, screenshot, or sufficient description)
  3. Your name, address, email address, and phone number
  4. A statement of good faith belief that the use is not authorised by the rights holder
  5. A statement, under penalty of perjury, that the information in your notice is accurate and you are authorised to act on the rights holder’s behalf
  6. Your physical or electronic signature

Valid, complete takedown requests will be actioned within 48 hours on weekdays. Requests received on weekends or public holidays will be actioned on the next business day.

8. Third-Party Brands and Links

THINGS displays products from third-party brands and may link to third-party websites. THINGS does not endorse, warrant, or guarantee any third-party brand, product, or website. Your interaction with any Third-Party Seller is solely between you and that seller. THINGS is not responsible for the products, services, policies, or practices of any third party.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THINGS DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. THIS DISCLAIMER APPLIES EXPRESSLY TO AI-GENERATED CONTENT, VIRTUAL TRY-ON OUTPUTS, AND PRODUCT RECOMMENDATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HUMAN TALES TECHNOLOGY PRIVATE LIMITED, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM; (B) ANY AI-GENERATED CONTENT OR RECOMMENDATION; (C) ANY PRODUCT PURCHASED FROM A THIRD-PARTY SELLER; OR (D) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA. THE COMPANY’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED INR 1,000 (RUPEES ONE THOUSAND ONLY).

11. Indemnification

You agree to indemnify, defend, and hold harmless Human Tales Technology Private Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your misuse of the ME virtual try-on feature.

12. Account Termination

THINGS reserves the right to suspend or permanently terminate your account at any time, with or without notice, for any violation of these Terms, including but not limited to misuse of ME, prohibited conduct, or any activity that threatens the safety, integrity, or reputation of the Platform or its users. Termination does not limit any other remedy available to THINGS.

13. Modifications to Terms

THINGS reserves the right to update these Terms at any time. Updated Terms will be posted on the Platform with a revised effective date. Material changes will be communicated to registered users via email or in-app notification. Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. The courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes arising from or relating to these Terms.

Any dispute not resolved through good-faith negotiation shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator, in English, with the seat of arbitration in Mumbai, India.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
